Ian successfully defended a client who had commissioned the construction of a luxury tree-house at a cost of over £10,000, against a claim by the liquidator of the company commissioned to build the tree-house, for monies which our client had withheld from paying due to significant defects in the structure. This involved interesting arguments about the required standard for a tree-house of this nature, the liquidator’s argument being that it was perfectly normal for a tree-house to leak and be drafty, even if it costs more than £10,000 and the brochure clearly encouraged people to believe they should fill the tree-house with high-end audio-video equipment..
